Lead Memo

šŸ«Øāš–ļø Elon Musk Sues OpenAI

Discovery in this case (if it makes it that far) will be a treasure trove of insight into corporate structure, Microsoft dealings, OpenAI AI models and tech, and how close we are to AGI (autonomous AI).

Here are some key points:

  • Elon is alleging breach of contract, promissory estoppel, breach of fiduciary duty, unfair competition, and accounting claims against the defendants

  • The complaint alleges that OpenAI, Inc. breached the founding agreement by licensing its technology exclusively to Microsoft, keeping the internal design of its latest model secret, and shifting its focus towards profit rather than the benefit of humanity.

  • OpenAI, Inc. was founded with the mission to develop AGI for the benefit of humanity, not for a for-profit company seeking to maximize shareholder profits.

  • Elon states GPT-4 is considered an early version of an artificial general intelligence (AGI) system. OpenAI has disagreed with this characterization before this complaint.

  • The complaint also claims that OpenAI, Inc.'s corporate structure has become more complex and that the new board lacks the technical expertise and independence to fulfill the non-profit mission.

I would write more but the complaint is too good - you should just read it!
