I am on the road today in the northern remote edges of Montana, Idaho, and Washington. I was unable to write for this section given travel.

But have no fear. I found this article and it is a banger! 

Having spoken to a handful of state bar ethics committees recently, I keep raising the question of how citizen use of generative AI will likely force bar associations and state courts to finally get serious about crafting a workable definition of unauthorized practice of law.

Why do I say get serious? Because most times UPL is written in a way that quite simply states something like “UPL is what lawyers say it is. We are the only ones that can practice law. We are the only ones that can define the practice of law. And we get to say what is the practice of law and what isn’t on a case-by-case basis.” Clear as mud.

So here is the story. When reading, ask yourself if this is a good use of generative AI. Is this a threat to lawyers? Is this practicing law on the part of the human or the AI tools he is using?
